Flavored Tobacco

San Francisco Health Code, Article 19Q:  Prohibiting the Sales of Flavored Tobacco Products was approved by San Francisco voters on June 5, 2018 and went into effect July 20, 2018. 

A flavored tobacco product is any tobacco product which contains an ingredient that imparts a characterizing flavor.   A “Characterizing flavor” is a distinguishable taste or smell, other than the taste or smell of tobacco. Please review and see the examples of flavored tobacco products on the Flavored Tobacco Products Sales Ban poster mailed to all San Francisco tobacco products retailers at the end of August 2018.

Now that the new law is in effect, San Francisco Tobacco Retailers are advised to:

  • Discontinue ordering and restocking flavored tobacco products
  • Visit the Environmental Health (EH) Flavored Tobacco Products webpage often
  • Read all mailings from the City and County of San Francisco
  • Voice questions and challenges at and attend at least one Listening Sessions, once scheduled
  • Provide feedback on draft Rules and Regulations once posted on website
  • Send questions to SF 311 at 311 or (415) 701-2311.

San Francisco Department of Public Health (SFDPH) in partnership with the Office of Economic Workforce and Development (OEWD) will support San Francisco tobacco retailers throughout by:

  • Monitors and enforces illegal sales of tobacco, including e-cigarettes, to any persons under 21 years old.
  • Enforces the prohibition of mobile tobacco, e-cigarettes, and ENDS sales in San Francisco.
  • Developing educational materials
  • Conducting on-site visits
  • Providing opportunities for retailers to voice their questions and challenges through Listening Sessions
  • Draft Proposed San Francisco Tobacco Products Licensing and Enforcement Rules and Regulations
  • Conduct Compliance Checks

SFDPH staff will commence enforcement activities after the rules and regulations become final in January 2019.
