Obtaining a Tobacco Permit


Businesses engaging in the sale, delivery, furnishing or marketing of tobacco, tobacco paraphernalia and e-cigarettes from one person to another in San Francisco require a permit. This permit must be renewed annually with an annual permit fee.


Application Form

Additional materials to ensure compliance with the requirements of the 2015 amendments to Article 19H are also required and will be provided to applicants after receipt of the original application packet.

Application Process

Step 1: Complete the pre-application to determine whether your establishment qualifies for a retail tobacco permit.

Step 2: If you wish to continue with the permit process, please proceed and apply. Once your application is complete, submit the following to the Department of Public Health, 1390 Market St., Suite 210, San Francisco, CA 94102:

    1. Completed application for the sale of tobacco products and/or e-cigarrettes.
    2. Retail Tobacco Permit Pre-Application, Affidavit, and Planning Referral.
    3. Declaration of Healthy and Safe Working Conditions
    4. A copy of your Cigarette/Tobacco License from the California Board of Equalization.
    5. A copy of your San Francisco Business Registration Certificate.
    6. Legal documentation of Notarized Purchase or Partnership Agreement with signatures of the tobacco permit holder (seller) and signatures of all owners, partners, or officers (buyers); Escrow paperwork with signatures of seller (tobacco permit holder) and buyer; Incorporation Documentation with Stock/Ownership percentages and signatures; Any other legal or notarized documentation that provides proof of exception or proof of ownership percentages.


An application review is required at the front desk and incomplete applications will not be accepted.


Permit applications must be accompanied by a check for the application fee payable to the "San Francisco Department of Public Health." The application fee is non-refundable. Before submitting an application for a retail tobacco sales permit, please contact SFDPH staff to help you understand if the 2015 amendments to Article 19H will affect your application.
