Resolution:

Authorizing the Director of Health To Enter Into a Contract With Public Health Foundation Enterprises, Inc. To Engage In a Preventive HIV Vaccine Efficacy Trial, April 8, 1997

WHEREAS, the Department of Public Health, AIDS Office, has been engaged in a preventive HIV vaccine preparedness study for three years; and,

WHEREAS, the Federal Drug Administration has now authorized the testing of two preventive HIV vaccines in controlled studies; and,

WHEREAS, the Department of Public Health, AIDS Office, desires to participate in the testing of the preventive HIV vaccine; and,

WHEREAS, to participate in the study the Department of Public Health must enter into a contract with Public Health Foundation Enterprises, Inc.; and,

WHEREAS, under the proposed contract the City would recruit volunteers for the study and administer the preventive HIV vaccines or a placebo to the participants; and,

WHEREAS, the proposed contract further provides that: 1) the City will hold Public Health Foundation Enterprises, Inc. harmless and indemnify Public Health Foundation Enterprises, Inc. from liability for the services provided by the City; 2) the Director of Health will have the authority to execute amendments to the contract without further approval by the Health Commission or Board of Supervisors; and 3) the Project Manager for the AIDS Office will have the authority to agree to changes to the cost or budget of the Preventive HIV Vaccine Efficacy Trial Program; now, therefore, be it

RESOLVED, that the Director of Health is hereby authorized to enter into the contract with Public Health Foundation Enterprises, Inc. for the participation of the City in the Preventive HIV Vaccine Efficacy Trial Study; and, be it

FURTHER RESOLVED, that the Health Commission recommends this contract to the Board of Supervisors.
