Resolution:

Urging the San Francisco Board of Supervisors To Designate the Department Of Public Health As the Lead Agency For Administration of Funds From the Substance Abuse Crime and Prevention Act of 2000, (Proposition 36), and To Establish a Substance Abuse Crime and Prevention Trust Fund

WHEREAS, the Substance Abuse Crime and Prevention Act of 2000 ("Proposition 36" or the "Act") was passed by California voters on November 7, 2000 and requires that certain nonviolent drug possession offenders receive drug treatment services in the community rather than incarceration; and,

WHEREAS, the California Department of Justice reports 10,679 drug arrests in San Francisco in 1999; and,

WHEREAS, the San Francisco District Attorney’s Office and the San Francisco Sheriff’s Office estimate that between 1,200 to 2,400 San Franciscans will qualify for drug treatment under this Act each year; and,

WHEREAS, substance abuse treatment has been shown to improve the health of drug addicts, reduce related health care costs, and reduce criminal activity of drug dependent persons after treatment; and,

WHEREAS, the California Department of Alcohol and Drug Programs has announced the allocation of $2.3 million to San Francisco for start-up costs for Proposition 36 in fiscal year 2000-01; and,

WHEREAS, in order to receive these funds, the San Francisco Board of Supervisors must: (1) agree to comply with the provisions of the Act; (2) establish a local Substance Abuse and Crime Prevention Trust Fund; (3) assure the State that all funds allocated pursuant to the Act shall be deposited in that trust fund; and (4) designate a lead agency within the City and County to be responsible for local coordination, development and implementation of the Act; and,

WHEREAS, the lead agency is required to: (1) coordinate the development of a City and County plan for implementation of the Act; (2) directly provide and/or contract for the provision of services; (3) administer funds received pursuant to the Act; (4) coordinate data collection and quarterly reporting; and (5) coordinate the evaluation of county programs; and,

WHEREAS, the San Francisco Department of Public Health has extensive experience working with substance abuse treatment and has taken the leadership role in the City’s Treatment on Demand Initiative; and,

WHEREAS, the San Francisco Department of Public Health has a long history of developing and administering grant-funded programs and complying with the significant reporting, data collection and evaluation requirements associated therewith; and,

WHEREAS, the San Francisco Department of Public Health has existing working and contractual relationships with the network of drug treatment service providers within the City; and,

WHEREAS, the Department of Public Health will collaborate on the planning and implementation of the provisions of the Act with interested community-based agencies and other affected City and County of San Francisco Departments; and,

WHEREAS, as the governing body of the San Francisco Department of Public Health, the Health Commission provides an open and public forum for community participation in the planning of health services in the City, which can be effectively used to guide implementation of Proposition 36; now, therefore, be it

RESOLVED, that the Health Commission of the San Francisco Department of Public Health urges the San Francisco Board of Supervisors to designate the San Francisco Department of Public Health as the lead agency for administration of funds from the Substance Abuse Crime and Prevention Act of 2000 (Proposition 36); and, be it

FURTHER RESOLVED, that Health Commission of the San Francisco Department of Public Health urges the San Francisco Board of Supervisors to establish a substance abuse crime and prevention trust fund into which all funds allocated pursuant to the Substance Abuse and Crime Prevention Act of 2000 will be deposited; and, be it

FURTHER RESOLVED, that, should it be designated as the lead agency, the Department of Public Health shall comply with the provisions of the Substance Abuse and Crime Prevention Act of 2000 and the California Code of Regulations, Title 9, Division 4, Chapter 2.5, on behalf of the City and County of San Francisco.
