Resolution Authorizing the Department of Public Health, San Francisco General Hospital To Accept a Gift of a Mobile Mammography Facility Vehicle and Associated Equipment, Valued At $432,716, Donated By The University Of California, San Francisco for Mobile Mammography Services to Indigent and Under-Served Women in San Francisco.

WHEREAS, the University of California, San Francisco (UCSF) is a not-for-profit public medical academic institution engaged in the provision of health-care services to disadvantaged residents of San Francisco, among other populations; and,

WHEREAS, San Francisco General Hospital (SFGH) is a public hospital that provides health-care services to the indigent and under-served residents of San Francisco; and,

WHEREAS, the mobile mammography facility vehicle (Mammovan), including the equipment, software, peripherals, and manuals was purchased by UCSF for the purposes of providing mammography services to indigent and under-served women in San Francisco; and,

WHEREAS, SFGH has committed to continue providing mobile mammography services to indigent and under-served women in San Francisco; and

WHEREAS, SFGH has received grant funding from the Avon Foundation for the continuation of the mobile mammography project initiated by UCSF; and

WHEREAS, UCSF has agreed to arrange for smog testing of the Mammovan and all other activities required to transfer title to the Mammovan to SFGH; and

WHEREAS, SFGH agrees, as a condition of the transfer, that UCSF and the Regents of the University of California assume no responsibilities and makes no guarantees for the performance of the equipment, that the Mammovan is being transferred on an “As Is’ basis without warranties as to fitness for use or merchantability, and that neither UCSF not the Regents of the University of California will be liable for any claims arising our of the possession or use of the Mammovan and associated equipment; and

WHEREAS, the Department wishes to obtain approval from the Health Commission and the Board of Supervisors to accept the gift of the Mammovan and the associated equipment; and now, therefore, be it

RESOLVED, That the Department of Public Health, San Francisco General Hospital is hereby authorized to accept a gift of the Mammovan, with a value of $432,716 from UCSF for the provision of mobile mammography services to indigent and under-served women in San Francisco.

I hereby certify that the San Francisco Health Commission at its meeting of September 7, 2004 adopted the foregoing resolution.
